Elk City, OK – An Elk City man was arrested after a shooting at a Clinton apartment complex left two people injured, including a man who remained in critical condition as of Oct. 29, according to a probable cause affidavit filed in Custer County District Court.
Juan Urbina, 27, was arrested in connection with alleged first-degree burglary, two counts of aggravated assault and battery, and carrying a weapon while under the influence of alcohol.
According to the affidavit, Clinton police responded to a shots-fired call at an apartment complex on South 30th Circle on Oct. 27. An arriving officer found Urbina sitting in a patio area. Urbina told the officer he had a gun, which the officer removed before detaining him.
Police also found a man and a woman suffering from apparent gunshot wounds. Both were flown to OU Health Medical Center in Oklahoma City. The man had been shot in the abdomen, while the woman suffered a gunshot wound involving her pelvic and buttock areas, the affidavit states.
During an interview, Urbina told investigators the confrontation began over car keys the injured man had taken from the woman. Urbina said he made two attempts to retrieve the keys. During the second attempt, he alleged, the man charged at him, struck his left arm with what he believed was a golf club and tried to push him down the stairs.
Urbina told investigators he fired three shots when the man charged him, according to the affidavit. He said he did not know what had happened to the apartment door.
The injured woman gave investigators a different account of how the confrontation escalated. She said the man took her keys because she had been drinking and he did not want her to leave. She told investigators she asked Urbina to remain downstairs because he was intoxicated and she wanted to avoid a fight.
According to her statement, Urbina followed her upstairs and exchanged words with the man, who was inside his apartment behind a closed, locked door. She alleged Urbina broke down the door after the man repeatedly told him to leave.
The woman said the man then came outside carrying a large tool and chased Urbina toward the stairs. She reported feeling pain in her lower back during the confrontation. The man subsequently returned to the doorway and slid down the wall, according to her account.
Investigators reported finding three spent cartridge cases and substantial damage to the apartment’s door frame. The affidavit states the deadbolt remained extended and the security latch was attached to a broken piece of the frame.
Investigators were unable to interview the injured man at the hospital because he was undergoing surgery. Hospital staff reported Oct. 29 that he remained in critical condition.
The allegations have not been proven in court. Urbina is presumed innocent unless proven guilty.
