Elk City, OK — An Elk City man has been charged with assault and battery with a dangerous weapon after allegedly threatening his neighbor and throwing a knife during a disturbance earlier this month.
Timothy Robert Tanner Cook, 28, was arrested February 3 at approximately 5:43 p.m. in the 700 block of South State Avenue. He is charged in Beckham County District Court with assault and battery with a sharp or dangerous weapon with intent to injure.
According to a probable cause affidavit, officers were dispatched around 5:03 p.m. to the home after a report of a disturbance. The caller told dispatch that Cook was yelling and making threats. The caller later reported that Cook was armed with a knife.
The alleged victim resides at at the home, while Cook lives next door.
Court documents state the victim and a friend were unloading fence panels in the backyard when Cook came outside and began yelling. Both men told police that Cook threatened to kill the victim if he did not leave the area.
The victim called police and reported that Cook briefly went back inside his residence before returning outside and continuing to threaten him. The victim then observed Cook holding a knife and called dispatch again to report the weapon.
The victim recorded part of the encounter on his phone. According to the affidavit, the video shows Cook and the victim yelling at each other before Cook throws an object toward him. The object landed several feet in front of the victim. The video then shows Cook pulling another object from his pocket and pointing it at the victim. Cook can be heard saying he “still has three of them,” possibly referring to knives. The video shows Cook holding a knife.
Police reported that Cook admitted he did not like the victim and did not want him around. Officers noted in the affidavit that Cook appeared argumentative and made exaggerated movements, at one point motioning as if he were brandishing a knife.
Cook was detained at the scene. A knife was later recovered near where the thrown object had landed and was seized as evidence. Photographs and written statements from the victim and a witness were attached to the report.
The victim told officers he felt threatened and feared Cook would harm him. He also stated there had been prior incidents and that the behavior had been escalating.
Cook was transported to the Beckham County Jail and booked without incident.
On February 4, a district judge found probable cause for the arrest. Bond was set at $50,000 with a condition that Cook have no contact with the alleged victim.
