Elk City Man Faces Multiple Drug and Firearm Charges in Custer County

Custer County, OK — An Elk City man is facing serious drug and firearm charges after authorities say he was caught with methamphetamine, marijuana, firearms, and drug paraphernalia earlier this month.

Jimmy Lee “Rusty” Davis, 64, of Elk City, was formally charged in Custer County District Court with trafficking in illegal drugs (methamphetamine), possession of a firearm after a former felony conviction, possession of a firearm during the commission of a felony, possession of marijuana, and unlawful possession of drug paraphernalia.

According to court filings, Davis was stopped on September 8, 2025, and was found in possession of more than 20 grams of methamphetamine, a substance classified as a Schedule II controlled dangerous substance. Prosecutors say he also had marijuana and multiple items of drug paraphernalia, including a glass pipe, used syringes, and rolling paper.

Authorities reported Davis had two firearms inside his vehicle — a CLL38 Black Derringer and a CL38 Black Derringer 38 Special — which he allegedly possessed despite prior felony convictions. State law prohibits convicted felons from owning or carrying firearms.

The trafficking charge alone carries a penalty of up to 20 years in prison and a fine of $25,000. Other charges include potential prison terms ranging from one to 10 years and additional fines.

Court records also show Davis has a lengthy criminal history, with prior felony convictions including forgery, assault and battery with a dangerous weapon, and feloniously pointing a firearm. His most recent conviction came in 2018, when a suspended sentence was revoked and he was ordered to serve seven years in prison.

Because of his prior record, Davis now faces an enhanced penalty of 20 years to life if convicted.

The case remains pending in Custer County District Court.
